FACTUAL STUDY ON VIABLE ALTERNATIVE METHODS FOR CHANGING THE SELECTION AND TENURE OF THE OFFICE OF UNITED STATES ATTORNEY GENERAL.
Abstract
THIS REPORT DESCRIBES BRIEFLY THE HISTORICAL DEVELOPMENT OF THE OFFICE OF ATTORNEY GENERAL OF THE UNITED STATES, AND THE FUNCTIONS OF THE DEPARTMENT OF JUSTICE, WHICH THE ATTORNEY GENERAL HEADS. IT SUMMARIZES CONSTITUTIONAL PROVISIONS AND CASE LAW CONCERNING THE PRESIDENT'S APPOINTMENT POWER, AND COMMENTS ON THE ROLE OF THE CABINET. CURRENT PROPOSALS FOR CHANGES IN THE METHOD OF SELECTING THE ATTORNEY GENERAL ARE DISCUSSED. COMPARATIVE SELECTION METHODS OF OTHER NATIONS ARE ALSO CITED. IN PREPARING THE REPORT, EXTENSIVE USE HAS BEEN MADE OF TESTIMONY BEFORE THE SUBCOMMITTEE ON SEPARATION OF POWERS OF THE SENATE COMMITTEE ON THE JUDICIARY, WHICH HELD HEARINGS IN MARCH AND APRIL OF 1974 ON PROPOSALS TO CHANGE THE METHOD OF SELECTING THE ATTORNEY GENERAL.
