THIS PAPER ADDRESSES THE NATURE AND EXTENT OF SELECTIVE OR DISCRETIONARY JUSTICE THROUGH RESEARCH ANALYZING JUDICIAL ATTRITION (CRIMES REPORTED V CRIMINALS INCARCERATED).
Abstract
THE FINDINGS WHICH ARE BASED ON NEW HAMPSHIRE CRIMINAL STATISTICS GIVE A DESCRIPTIVE PROFILE OF THE TYPICAL OFFENDER AND THE NATURE OF JUDICIAL ATTRITION. PERSONAL CRIMES WERE FOUND TO MOST LIKELY RESULT IN HARD (INCARCERATION) SENTENCES WHILE PROPERTY OFFENSES ARE MORE LIKELY TO LEAD TO SOFT (NON-INCARCERATION) SENTENCES. NON-JUDICIAL DISPOSITIONS, SUCH AS NOL PROCESS AND FIELD CHARGES, AS WELL AS PLEA BARGAINING PROBABLY BETTER REFLECT INTERPERSONAL ATTORNEY/PROSECUTOR COLLUSION THAN THEY RELATE TO ANY PARTICULAR TYPE OF CRIME....TWH
