This toolkit aims to help prevent firearms from getting into the wrong hands by advising persons who wish to sell their guns privately on how such sales can be conducted so as to prevent a sale to a person at high risk for using the gun to commit crime.
Abstract
Using a Federal Firearms Licensee (FFL) to make the sale to another person provides a secure process. In some States, this may be required under State law. Under Federal law, however, FFLs are not required to assist in private firearm transactions unless the buyer resides in a different State from the seller. Some FFLs will manage such sales for a fee, but some may choose not to become involved in private sales. Federal law prohibits certain persons from shipping, transporting, possessing, or receiving firearms or ammunition. This report lists the factors that disqualify a person from shipping, transporting, possessing, or receiving firearms or ammunition. 4 annotated resource listings and appended guidelines for private sellers
