DISCUSSION OF PROBLEMS OF DEFINITION AND PROCEDURE IN DISTINGUISHING BETWEEN TWO SIMILAR MEASURES WHICH PLACE INMATES UNDER CONDITIONS OF REDUCED SECURITY, GREATER FREEDOM, AND LIMITED CONTACT WITH THE OUTSIDE WORLD.
Abstract
THE TWO MEASURES DIFFER IN THE EMPHASIS OF THEIR GOALS. THE GOAL OF SEMI-LIBERTY IS TO FACILITATE RESOCIALIZATION. THE GOAL OF SEMI-DETENTION IS TO AVOID THE NEGATIVE EFFECTS OF COMPLETE DEPRIVATION OF FREEDOM. IN THE LATTER CASE, THE INMATE CONTINUES IN HIS OLD JOB, RECEIVES HIS NORMAL SALARY, AND SUPPORTS HIS FAMILY, BUT HE SPENDS HIS NIGHTS IN THE INSTITUTION. NEITHER MEASURE IS PROVIDED FOR IN THE SWISS CORRECTIONAL CODE, WHICH HAS GIVEN RISE TO CONFUSION OVER THESE APPLICATIONS. --IN FRENCH
