Abstract
THE DEFENSE COUNSEL CAN DO MUCH TO HAVE THE SYSTEM RESPOND TO THE INDIVIDUAL NEEDS OF THE PERSON BEING SENTENCED. IT IS POSSIBLE FOR A CONSCIENTIOUS DEFENSE ATTORNEY TO EDUCATE THE JUDICIARY AND PERSUADE IT TO CONSIDER ALTERNATIVES TO INCARCERATION. TO AID HIS CLIENT AS MUCH AS POSSIBLE A DEFENSE LAWYER SHOULD BE PREPARED TO-OBTAIN PRE-TRIAL RELEASE FOR HIS CLIENT, EXPLORE COMMUNITY DIVERSIONARY PROGRAMS FOR WHICH HIS CLIENT MIGHT BE ELIGIBLE, WRITE A SENTENCING MEMORANDUM ON BEHALF OF HIS CLIENT, AND MAINTAIN CONTACT WITH HIS CLIENT IN PRISON OR ON PROBATION.
