Homicide in New South Wales, Australia, was studied from the perspective of sentencing outcomes, with emphasis on the sentencing of those convicted of murder and manslaughter, the use of partial defenses and their impact on sentencing, and the characteristics of specific types of homicides such as the killing of children and sexual partners.
Abstract
The research used data from all homicide offenders sentenced as principals between January 1990 and August 1993. The data showed that 36 of 129 offenders convicted of murder were sentenced under section 19 and received custodial sentences, including 29 life sentences. In addition, all 93 offenders sentenced under section 19A received a custodial sentence, including 6 life sentences. Furthermore, the 126 manslaughter offenders received sentences ranging from bonds to full-time penal servitude. A total of 88.1 percent of the offenders received custodial sentences, 2 offenders were sentenced to penal servitude to be served by way of periodic detention, and the rest received noncustodial sentences.
