In recent years, the Kentucky Legislature has passed laws giving circuit and district courts in the State more options at sentencing hearings for offenders with substance abuse problems.
Abstract
About 18 percent of Kentucky's correctional population are incarcerated on alcohol or drug offenses. Kentucky statutes allow for community service, probation, or conditional discharge with an alternative sentencing plan for these individuals. Based on careful evaluation of an offender, an alternative sentencing plan can be developed to meet that person's substance abuse needs. The most critical part of this plan involves treatment. Possible treatment alternatives include Alcoholics Anonymous, Narcotics Anonymous, individual counseling, inpatient treatment programs, long-term treatment programs, aftercare programs, halfway houses, and community-based substance abuse treatment programs. Sentencing options encompass home incarceration or house arrest, jail release, split sentences, community service, and educational or employment programs. Developing an alternative sentencing plan specifically designed to meet an offender's substance abuse needs reduces the likelihood of his or her future involvement in the criminal justice system.
