Based on the findings of more than two decades of research on interventions in impaired driving and their effectiveness, this sentencing guide is designed to assist judges and prosecutors in reducing recidivism among people convicted of drinking and driving offenses.
Abstract
The introduction profiles DUI (driving under the influence) offenders and repeat offenders, followed by a discussion of the significance of blood alcohol concentration. The introduction also outlines measures for reducing recidivism, advising that the key to reducing DUI recidivism is certain, consistent, and coordinated sentencing. Section II discusses the objectives of sentencing, considerations in sentencing, factors that influence risk for recidivism, and guidelines for evaluating the offenders. Section III focuses on specific sanctions and remedies. Options for sanctioning the offender include jail, weekend intervention, dedicated detention, and probation. Options of incapacitating the vehicle include ignition interlocks and other immobilization devices. Remedies encompass license suspension, administrative license suspension, and vehicle impoundment and forfeiture. Some additional sentencing approaches are also discussed. Section IV describes rehabilitation options for offenders sentenced to treatment. They encompass education programs and treatment programs (medications, diversion programs, and Alcoholics Anonymous). Other sections discuss compliance and reporting, as well as sentencing support and research needs. 102 references
