This appendix reproduces the 'Sentencing Guidelines Manual' as revised by the U.S. Sentencing Commission, effective January 15, 1988.
Abstract
The guidelines are intended to introduce greater honesty, proportionality, and uniformity into Federal sentencing practice by taking into consideration the characteristics of offenses and offenders that appear relevant to the specified purposes of sentences. In addition to outlining general guideline application principles, guidelines cover 19 major offense categories, including property and person offenses, offenses involving public officials and administration of justice, racketeering, fraud, and drug offenses. For each Federal offense, the guidelines specify a range of appropriate sentencing ranges depending upon different combinations of offense and offender characteristics, adjustments, and criminal history category. Guidelines also include commentary and application notes. A sentencing table is provided for determining sentence ranges for 43 offense levels and 6 criminal history categories. Conditions for a range of sentencing options are delineated, including probation, imprisonment, supervised release, restitution, fines, and forfeitures. Also included are policy statements on sentencing procedures, plea agreements, and violations of supervised release and parole. A statutory index, authorizing legislation, amendments, and illustrations of the guidelines' operation are appended.
