Abstract
A section on establishing facts and providing reasons contains articles on lawlessness in sentencing; establishing a factual basis for sentencing; criminal law as the missing element in sentencing reform; and reasons for sentence. "Having a Say on Sentence" presents articles on social inquiry for the courts; pre-sentence reports; the modern role of defense counsel and of crown prosecutor in the sentencing process; and victims' voices in criminal court. "Issues of Evidence and Process" reviews sentencing problems raised by guilty pleas; whether plea bargaining is inevitable; rules of evidence in the sentencing process; how unreliable fact-finding can undermine sentencing guidelines; fact finding in Federal sentencing and why the guidelines should meet the rules; and sentences without conviction--from status to contract in sentencing.
