THIS ARTICLE RAISES THE QUESTION OF WHETHER WOMEN AS LITIGANTS SUFFER BY THE RELATIVE LACK OF WOMEN JURORS.
Abstract
IN ANSWERING THIS QUESTION, THE AUTHORS DREW ON THE RESULTS OF AN EMPIRICAL STUDY ON JURY SEX BIAS AND PRESENT A DATA TABLE ON HOW THE TREATMENT OF FEMALES DIFFERS FROM MALES IN PERSONAL INJURY CASES. THE TABLE INDICATES THAT INEQUALITY BETWEEN MEN AND WOMEN SEEMS TO BE GREATER IN THE AMOUNT OF DAMAGES AWARDED THAN IN THE ESTABLISHMENT OF LIABILITY. THE AUTHORS CONCLUDE THAT PROVIDING MORE EQUAL REPRESENTATION OF MALES AND FEMALES AS JURORS WILL HELP TO PROVIDE MORE EQUAL TREATMENT OF MALES AND FEMALES AS CRIMINAL DEFENDENTS AND PERSONAL INJURY PLAINTIFFS.
