The guide explains the complex legal concepts governing the rights and liabilities of those trying to stop a shoplifting incident. It examines the catastrophic consequences that can result from ignorance of the governing rules of law.
Abstract
The text provides indepth coverage of shoplifting's impact on profits, the severe repercussions of false arrest laws, and methods of deterring shoplifting. It discusses how to determine when a customer becomes a thief, how to detain a shoplifting suspect, how to avoid punitive damages, and when the retailer should prosecute. Situations calling for prosecution of adult suspects are detailed, and the procedure for handling juvenile suspects is noted. How to handle evidence and how to behave as a witness in court also are reviewed. In addition, the discussion covers problems involving insurance coverage, credit card and check frauds, using private guard firms, and special police officer status. The book should assist retailers, store managers, and store personnel in taking steps against shoplifting. It includes notes, an index and an unofficial 'shoplifting report form' for the retailer's use in determining whether sufficient grounds for a shoplifting charge exist. An appendix presents individual State statutes specifically dealing with shoplifting. (Author summary modified)
