THIS ARTICLE IS A CRITIQUE OF THE USE OF SHORT PRISON SENTENCES AND PROPOSALS FOR ALTERNATIVE, NON-DETENTIVE SENTENCES IN ITALY.
Abstract
THE AUTHOR REFLECTS THE GENERAL UTILITY OF SHORT PRISON SENTENCES ON THE GROUNDS THAT THEY FAIL AS A DETERRENT, THEY DO NOT PERMIT EFFECTIVE RE-EDUCATION OF THE PRISONER AND PLACE HIM IN DANGER OF BECOMING MORE DEEPLY INVOLVED IN A CAREER OF CRIME. SHE ARGUES THAT THE NOTION OF INCORRIGIBILITY IS UNACCEPTABLE, AND THAT PROVISIONS OF THE ITALIAN CRIMINAL CODE WOULD PERMIT THE USE OF SUCH MEASURES AS SUSPENDED SENTENCES, SOCIAL SERVICE PROGRAMS AND SEMI-LIBERTY. --IN ITALIAN
