DEFINITION OF THE DIFFERENTIATING CHARACTERISTICS AND OF THE RELATIONSHIPS BETWEEN THE SOCIOLOGY OF CRIMINAL LAW, THE SOCIOLOGY OF LAW, AND CRIMINOLOGY AS CONCEIVED OF IN EUROPEAN LEGAL THINKING.
Abstract
IN THE FIRST PART OF THE ESSAY, THE AUTHOR DEFINES THE CRITERIA FOR RECOGNIZING THE UNITY AND AUTONOMY OF SOCIOLOGY OF LAW IN RELATION TO BOTH GENERAL SOCIOLOGY AND SCIENCE, PHILOSOPHY AND THEORY OF LAW. IT IS THE OPINION OF THE AUTHOR THAT THE AUTONOMY OF EACH OF THESE DISCIPLINES CAN ONLY BE DEFINED BY THEIR RESPECTIVE OBJECTS OF STUDY. THE OBJECTS OF SOCIOLOGY OF LAW ARE THOSE TYPES OF BEHAVIOR WHICH GIVE RISE TO LEGAL NORMS, AND MAY BE CONSIDERED AS AN EFFECT OF LEGAL NORMS. THE SOCIOLOGY OF CRIMINAL LAW STUDIES THE FORMULATION AND APPLICATION OF A PARTICULAR CRIMINAL JUSTICE SYSTEM. THE AUTHOR CONCLUDES BY STRESSING THE NECESSITY OF AN INTEGRATION OF THE MICRO-SOCIOLOGICAL APPROACH OF EACH SEPARATE BRANCH OF SOCIOLOGY. --IN ITALIAN
