Penal law and the definition of crime in Germany have steadily moved away from punishment as the sole consequence of crime and toward alternative measures that can still protect society.
Abstract
In the theoretical sense, any crime definition can be arranged as long as there is sufficient political support. According to its self-concept, penal law concentrates on the most dangerous criminal cases and on the protection of basic life conditions. In the eyes of criminology, however, the more penal law is needed, the less penal law is able to bring about the promised protection. Difficulties associated with the criminal justice system are discussed in relation to social interests and the need of society for protection against crime. The impact of the mass media on criminal activities and concepts and the need to guarantee individual rights and liberties are also addressed. The concept of crime is regarded as a middle range concept, one that is necessary for daily life. 14 footnotes
