This Special Project addresses four significant areas of drug enforcement law: drug diplomacy and the U.S. supply-side drug strategy, the legal implications of interdicting drug couriers, government drug testing, and drug proceeds forfeiture and the right to counsel of choice.
Abstract
The first article surveys and critiques United States efforts to use international diplomacy and extradition to interdict the supply of drugs entering the country. Another article explores the courts' response to the increased use of the "drug courier profile" by law enforcement officials as sufficient probable cause for a search of a suspect's property. A third article addresses recent U.S. Supreme Court decisions that have relaxed the individualized suspicion requirement for testing government employees for drug use. In discussing the drug proceeds forfeiture statute and its impact on the right of defendants to the counsel of their choice, the concluding article advocates exempting attorney's fees from drug proceeds forfeiture.
