THIS PAPER IDENTIFIES MAJOR ISSUES AND PROBLEMS IN THE SPEEDY TRIAL ACT OF 1974 AND MAKES RECOMMENDATIONS FOR STREGTHENING THE LAW.
Abstract
A GENERAL SUMMARY AND LEGISLATIVE HISTORY OF THE ACT ARE PRESENTED. MAJOR PROBLEMS OF POLICY AND INTERPRETATION OF THE ACT WHICH ARE IDENTIFIED INCLUDE THE STRUCTURE AND LENGTH OF THE TIME LIMITS, STATUTORY EXPECTIONS TO PROVISIONS OF THE ACT, THE INTERIM LIMITATIONS TO BE EFFECTED PRIOR TO IMPLEMENTATION OF THE ACT IN 1979, AND LACK OF PROVISIONS MADE FOR THE ACT'S RESEARCH AND PLANNING COMPONENT. RECOMMENDATIONS INCLUDE RECONSIDERATION OF THE LENGTH AND STRUCTURE OF THE PERMANENT TIME LIMITS ESTABLISHED UNDER THE ACT AND ELIMINATION OF SOME EXCEPTIONS AND STRICTER INTERPRETATIONS OF OTHERS.
