THE MCNAGHTEN RULING IS SEEN TO BE A PULLING TOGETHER OF RULINGS FROM A NUMBER OF PRECEDENTS THAT DEALT WITH THE INSANITY ISSUE TO GIVE A DEFINITIVE, WORKABLE RULE FOR MEASURING INSANITY IN A SPECIFIC CRIME.
Abstract
IT IS CONCLUDED THAT WHILE THE MCNAGHTEN RULING HAS HISTORICAL IMPORTANCE AS A PRECEDENT, ITS DEFINITION OF THE INSANITY TEST WAS NOT A REVOLUTIONARY DEVELOPMENT. CASES DEALING WITH INSANITY THAT PRECEDED MCNAGHTEN ARE DISCUSSED.
