EXAMINATION OF CERTAIN SIMILARITIES BETWEEN THE INSANITY DEFENSE AND THE COMMITMENT OF NON-DANGEROUS MENTALLY ILL INDIVIDUALS, WITH THE PROPOSAL THAT THE DEFINITION OF BOTH BE MADE UNIFORM.
Abstract
THE CURRENT JUDICIAL TESTS OF THE INSANITY DEFENSE AND LEGISLATURE STANDARDS OF POLICE POWER COMMITMENTS ARE REVIEWED AND COMPARED. THE PROBLEMS ASSOCIATED WTH VAGUE AND INCONSISTENT STATUTORY LANGUAGE ARE DISCUSSED AS WELL AS THE DANGERS OF BROAD PSYCHIATRIC DIAGNOSIS. THE SIMILAR CHARACTERISTICS OF INSANITY DEFENDANTS AND NON-DANGEROUS MENTALLY ILL INDIVIDUALS ARE CONTRASTED WITH THE ENORMOUS DIFFERENCES IN THE CONSEQUENCES OF THE INSANITY DEFENSE AND POLICE POWER COMMITMENT....MSP
