This is the 2012 Annual Report of the California Commission on Judicial Performance, whose mandate is "to protect the public, enforce rigorous standards of judicial conduct, and maintain public confidence in the integrity and independence of the judicial system."
Abstract
The first two sections of this annual report present an overview of the commission's complaint process regarding judicial performance, as well as the commission's legal authority and the procedures for managing complaints it receives. The report's third section presents 2012 statistics on complaints received and investigated, including deferral of investigation, complaint dispositions, and a 10-year summary of commission activity. The report's fourth section presents case summaries of active and former judges, distinguished by dispositions of "public discipline" (removal from office, public censure, and public admonishment) and "private discipline" (private admonishments and advisory letters). The report's fifth section focuses on commission procedures pertinent to subordinate judicial officers, including statistics on complaints received and dispositions. The report's sixth section contains data on judicial disability voluntary and involuntary retirements as well as amendments to disability policy declarations. The report concludes with data on the commission's 2012-2013 and 2011-2012 budgets. Appendixes address the commission's governing provisions, the California Code of Judicial Ethics, the complaint form, and a commission proceedings chart.
