A DEMONSTRATION PROGRAM TO PROVIDE STATE-FUNDED TRIAL AND APPELLATE DEFENSE SERVICES FOR INDIGENTS IN OKLAHOMA IS PROPOSED.
Abstract
THE PROGRAM WOULD ESTABLISH A PUBLIC DEFENDER OFFICE IN THE 21ST JUDICIAL DISTRICT, A THREE-COUNTY URBAN/RURAL AREA WITH AN ASSIGNED COUNSEL SYSTEM FOR PROVIDING DEFENSE SERVICES TO INDIGENTS. THE PUBLIC DEFENDER OFFICE, WORKING IN CONJUNCTION WITH THE ASSIGNED COUNSEL SYSTEM IN ONE COUNTY AND HANDLING ALL INDIGENT CASES IN TWO, WOULD CONDUCT INVESTIGATIONS, ASSURE EARLY ACCESS TO COUNSEL, REPRESENT INDIGENTS AT TRIAL, AND DEVELOP TRAINING PROGRAMS FOR DEFENDERS. THE DEMONSTRATION PROGRAM WOULD ALSO ESTABLISH AN AGENCY WITHIN THE STATE CENTER FOR CRIMINAL JUSTICE TO PROVIDE STATEWIDE APPELLATE DEFENSE SERVICES FOR INDIGENTS. THE PROPOSAL COVERS THE BACKGROUND OF OKLAHOMA'S EFFORTS TO IMPROVE DEFENSE SERVICES FOR INDIGENTS; FINDINGS THAT LED TO SELECTION OF THE 21ST DISTRICT FOR DEMONSTRATION PURPOSES; AND DETAILS OF THE PROPOSED DEMONSTRATION, INCLUDING ORGANIZATION, STAFFING, AND BUDGETS FOR THE FIRST 3 YEARS.
