In this statement, Victoria Toensing presents the views of the Department of Justice (DOJ) on the Narcoterrorism Information Rewards Act (H.R. 2768), and the Federal Drug Law Enforcement Agent Protection Act of 1985 (H.R. 2013 and S. 630.
Abstract
These bills are aimed at facilitating the apprehension and conviction of drug traffickers guilty of kidnapping and murdering drug law enforcement officials or members of their immediate families. While the DOJ supports the purpose of these bills, certain problems are apparent in the provisions of H.R. 2013 and S. 630. First, both structure a reward system through the DOJ Assets Forfeiture Fund, a purpose for which it is not mandated. However, this problem is remedied by the appropriations authorization of H.R. 2768. Second, the language of H.R. 2013 and S. 630 is insufficiently broad to achieve the purpose of the bills. These deficiencies are, again, made up by H.R. 2768's broader definition of officials covered under the Act, the inclusion of family members, and recognition of the role of the Department of State in international efforts. Because of these improvements, DOJ supports enactment of H.R. 2768. 2 footnotes.
