This manual describes the content and application of North Carolina's new sentencing law for felonies; the laws apply to all felony offenses committed on or after October 1, 1994 and are codified in Article 81B of Chapter 15A of the North Carolina General Statutes.
Abstract
The manual explains the six steps involved in applying the laws: (1) determine the appropriate offense class for the conviction; (2) determine the prior record level for the offender; (3) consider aggravating and mitigating factors; (4) select a minimum sentence from the sentence range; (5) determine the maximum sentence; and (6) impose an active, intermediate, or community punishment. Additional sections describe additional sentencing, probation, and postrelease supervision provisions and provide sample exercises, answers, and commentary.
