North Carolina's structured sentencing laws that became effective on October 1, 1994 apply to all misdemeanor offenses committed on or after that date, and the substance and application of the laws are described in this training and reference manual.
Abstract
The new sentencing laws are codified in Article 81B of Chapter 15A of North Carolina's General Statutes. The first section of the manual describes steps required to apply the new sentencing laws: (1) determine the misdemeanor class; (2) determine the prior conviction level; (3) select the sentence length from a sentence range; and (4) determine the sentence disposition and impose active, intermediate, or community punishment. Subsequent sections of the manual contain additional probation provisions and sample exercises. Relevant forms and an explanation of misdemeanor offense classes are appended.
