This document describes the Student Court program instituted in a North Carolina high school, which allows students facing disciplinary action to be judged by a peer jury.
Abstract
Student Court is structured in a manner similar to Superior Court and offers student offenders an alternative to out-of-school suspension. The students who act as judge, jurors, school and student advocates, clerks, and probation officers are enrolled in courses on judicial review and court training; this experience reinforces their classroom instruction. Student Court deals with Level One violations of the school conduct code, which cover, inter alia, profanity, smoking in unauthorized areas, littering, insubordination, cheating, and gambling. This document outlines the Student Court procedures and includes the Student Court case data sheet, student affidavit of case facts, notice of arraignment, Student Court judgment/guilty plea, notice of trial date, Student Court subpoena, witness truth of testimony affidavit, staff affidavit of testimony, notice of verdict/sentencing hearing, juror verdict justification, jury recommendation for sentencing, acknowledgement of verdict/sentence, administration approval of sentence, administration approval of acquittal, probation officer report, and defendant evaluation of Student Court.
