This task force report reviews current policies and procedures of the New Jersey municipal court system and recommends reforms to upgrade its status and improve its performance.
Abstract
Management recommendations focus on the roles of the vicinage presiding judges, case managers, advisory committees, management assistance teams, and the court services unit. Issues in the area of calendar management, community dispute resolution, pretrial intervention, scheduling conflict and postponements, docketing, case processing, handling of traffic violations, and evaluation of calendar performance also are addressed. Personnel reforms relate to judicial qualifications, tenure, compensation, and liability; selection, employment, and termination of court personnel; the prosecutor's role; and appointment of counsel. Budget and financing reforms concern budget reporting and caps, use of an impasse procedure, and revenue distribution. Trial issues addressed include cost and service of bench warrants, complaints, advisement of rights, court interpreters, bail, and trials de novo. Special issues also are considered, including domestic violence, drunk driving, victim-witness services, and sentencing. Facility and operational recommendations refer to facility standards, security, and computerization. Finally, guidelines for reform implementation and funding are provided.
