THIS STUDY, DATED MAY 1976, DESIGNS A PILOT REGIONAL RURAL DEFENDER SYSTEM WHICH WOULD PROVIDE QUALITY REPRESENTATION TO INDIGENT CLIENTS IN CRIMINAL, JUVENILE, AND MENTAL HEALTH CASES IN NORTH CAROLINA DISTRICTS.
Abstract
THE FIRST, SECOND AND SIXTH JUDICAL DISTRICTS CONTAIN APPROXIMATELY 280,000 PERSONS IN THE HIGHLY RURAL COASTAL REGION OF NORTH CAROLINA. ACCORDING TO THE 1970 CENSUS, OVER 30 PERCENT OF THE POPULATION ARE POOR. THE TRIAL LEVEL JUDICIAL PROCESS IN NORTH CAROLINA IS DIVIDED INTO MAGISTRATE COURTS, DISTRICT COURTS, AND SUPERIOR COURTS. THIS REPORT ANALYZES THE PROBLEMS, NEEDS, WORKLOAD AND STAFFING DETERMINATIONS OF THE PRESENT ASSIGNED COUNSEL SYSTEM AND RECOMMENDS AND DESIGNS A PILOT REGIONAL DEFENDER PROGRAM.
