CASE LAW CITATIONS AND NARRATIVE ARE PRESENTED TO EXPLAIN PRISONERS' RIGHTS ACCORDING TO CERTAIN AMENDMENTS. LIABILITY FOR VIOLATION OF PRISONERS' RIGHTS IS DISCUSSED.
Abstract
PRISONERS' RIGHTS IN MICHIGAN IN REGARD TO RELIGION, SPEECH, MAIL, ACCESS TO MEDIA, GROOMING AND CLOTHING, VISITATIONS, SEARCH AND SEIZURE, LIVING STANDARDS, PUNITIVE SEGREGATION, USE OF FORCE, CAPITAL PUNISHMENT, MEDICAL CARE, AND PHARMACEUTICAL TESTING ARE CONSIDERED IN THE TRAINING MATERIAL. EQUAL PROTECTION AND DUE PROCESS OF THE LAW IS DISCUSSED INCLUDING ACCESS TO THE COURTS, DISCIPLINARY HEARINGS AND LOSS OF GOOD TIME, AND SECURITY CLASSIFICATION AND TRANSFER. IMMUNITY IS THE USUAL DEFENSE IN CASES WHERE A PRISONER'S RIGHTS ARE VIOLATED; IT APPLIES IN CASES OF NONDISCRETIONARY ACTION INVOLVING GOOD-FAITH ENFORCEMENT OF DUTY. IMMUNITY CAN ALSO BE GRANTED IN CASES OF DISCRETIONARY ACTION IN WHICH EMPLOYEE ACTION IS AUTHORIZED, IN WHICH THERE IS REASONABLE GROUNDS FOR ACTION TAKEN, OR IN WHICH THE EMPLOYEE HAD A GOOD-FAITH BELIEF THAT THE ACTION TAKEN WAS PROPER.
