Transfer of criminal proceedings is discussed.
Abstract
This report discusses issues raised regarding the transfer of criminal proceedings, including more effective administration of criminal justice, improved international cooperation in criminal justice matters, and improved social resettlement of offenders. The report urges the Committee on Crime Prevention and Control to finalize the draft model agreement regarding transfer of proceedings in criminal matters, a copy of which is contained as an annex to the report, for submission to the Eighth United Nations (UN) Congress on the Prevention of Crime and the Treatment of Offenders. The report states that the adoption of the model agreement could result in reciprocal formal acknowledgment of the validity of foreign criminal judgments, contribute to the reduction of pre-trial detention and to the solution of problems of concurrent jurisdiction and plurality of proceedings, and further international recognition of the principle of double jeopardy. The draft model agreement is based on the results of the International Expert Meeting on UN Law and Enforcement held in 1987.
