NARRATIVE PRESENTATION OF THE DEFENSE COUNSEL'S ROLE IN THE STAGES OF AN ORDINARY CRIMINAL CASE FROM ARREST AND INVESTIGATION TO APPEAL, ALONG WITH A BIBLIOGRAPHY OF CRIMINAL PROCEDURE.
Abstract
THE TRIAL MANUAL FOR THE DEFENSE OF CRIMINAL CASES GUIDES THE NEW DEFENSE LAWYER THROUGHOUT THE WHOLE OF THE CRIMINAL JUSTICE PROCESS FROM ARREST THROUGH APPEAL AND POST-CONVICTION PROCEEDINGS. THIS LOOSELEAF VOLUME CONSISTS OF FOUR PARTS. THE FIRST, THE GUIDELINES FOR CRIMINAL DEFENSE, IS A HANDBOOK OF CRIMINAL PRACTICE FOR THE DEFENSE ATTORNEY WHICH IDENTIFIES CRITICAL POINTS IN THE PROCEEDINGS, AND WARNS OF RIGHTS TO BE ASSERTED AND OF INTERESTS TO BE PROTECTED AT EACH STAGE. IT DESCRIBES BRIEFLY THE PRACTICES AND PROCEDURES NECESSARY OR USEFUL FOR THE ASSERTION OF RIGHTS AND THE PROTECTION OF INTERESTS OF THE DEFENDANT, AND SUGGESTS THE STEPS THAT SHOULD BE TAKEN OR CONSIDERED BY DEFENSE COUNSEL AT THE VARIOUS STAGES OF THE CASE. PART II INDEXES THIS MATERIAL AND INCLUDES A TABLE OF CASES AND AUTHORITIES CITED IN THE GUIDELINES AND A SUBJECT INDEX. THE THIRD PART, A SELECTED BIBLIOGRAPHY OF CRIMINAL PROCEDURE, IS DESIGNED AS A RESEARCH AID TO THE CRIMINAL DEFENSE ATTORNEY. IT LISTS BOOKS, ARTICLES, AND ANNOTATIONS AS WELL AS CASENOTES WHICH COMMENT UPON RECENT IMPORTANT DECISIONS WHICH HAVE NOT YET FOUND THEIR WAY INTO MORE GENERAL WRITINGS. THE FINAL SECTION CONTAINS A GENERAL OUTLINE AND A DETAILED OUTLINE OF THE TOPIC HEADINGS UNDER WHICH THE BIBLIOGRAPHY IS ORGANIZED. THE LOOSE LEAF FORMAT IS DESIGNED TO ALLOW USERS TO INTERFOLIATE NOTES ON LEADING CASES, RULES OF PRACTICE, AND OTHER MATTERS OF SIGNIFICANCE IN THEIR LOCAL JURISDICTIONS. IT ALSO PERMITS THE PUBLISHER TO UPDATE THE TRIAL MANUAL YEARLY BY ISSUING REPLACEMENT PAGES INSTEAD OF REPRINTING THE ENTIRE VOLUME. (SNI ABSTRACT)
