This document, produced by the National Indian Justice Center (NIJC) contains a justice code for tribal juvenile delinquency proceedings and a commentary which can help tribes decide whether to adopt the code.
Abstract
Chapters cover the purpose of the code; definitions; jurisdiction of the juvenile court; transfer to tribal court; noncriminal and other proceedings; relations with other agencies; juvenile judges, counselors, and other court personnel; rights of involved parties; custody procedures; detention; initiation of proceeding against juvenile offenders; consent decree; adjudication proceedings; predisposition studies and proceedings; review, modification, revocation, extension, or termination of dispositional orders; families in need of services; juvenile records; and juvenile appeals. The code was developed in July 1987 for the Bureau of Indian Affairs in order to comply with the Indian Alcohol and Substance Abuse Act of 1986, and was subsequently revised; the final version was presented in March 1989. A separate NIJC document covers child abuse and neglect.
