DEFICIENCIES IN THE OPERATION OF EXISTING GRAND JURIES AND THE STATUS OF LEGISLATION IN CALIFORNIA TO ESTABLISH A TWO GRAND JURY SYSTEM.
Abstract
THE TWO GRAND JURY SYSTEM WOULD DIVIDE THE WORKLOAD OF THE EXISTING OVERWORKED GRAND JURY. THE TRIAL JURY LIST WOULD BE USED FOR THE SELECTION OF A GRAND JURY TO RETURN INDICTMENTS, WHILE SPECIALLY QUALIFIED PERSONS WOULD BE SELECTED TO PERFORM THE GRAND JURY 'WATCHDOG' FUNCTION - INSPECTING JAILS, INVESTIGATING ACCUSATIONS AGAINST PUBLIC OFFICIALS, AND AUDITING LOCAL GOVERNMENT FINANCIAL RECORDS. THE ATTITUDES OF CALIFORNIA PROSECUTORS AND DEFENSE ATTORNEYS TOWARD THIS CONCEPT ARE PRESENTED.
