COMMISSION PROJECT TO DEVELOP A COMPREHENSIVE AND HIGH QUALITY SET OF RULES OF CRIMINAL PROCEDURE FOR ADOPTION BY THE STATES.
Abstract
THE FINAL PROPOSED RULES OF CRIMINAL PROCEDURE, TO BE COMPLETED IN 1974, WILL SUGGEST THE FOLLOWING CONCEPTS BE ADOPTED BY THE STATES - (1) CENTRALIZING IN THE PROSECUTOR RESPONSIBILITY FOR INITIATION AND CONTROL OF CRIMINAL PROSECUTIONS AND CORRESPONDINGLY DECREASING THE ROLE OF THE PRIVATE CITIZEN AND THE POLICE IN THIS RESPECT, (2) USE OF CITATION AND SUMMONS PROCEDURES IN LIEU OF ARREST, (3) SPECIFYING IN DETAIL CAUTIONARY WARNINGS TO AND THE HANDLING OF DEFENDANTS TAKEN INTO CUSTODY, (4) STREAMLINING THE JUDICIAL PROCESS, (5) PROVISION OF BROAD DISCOVERY FOR PROSECUTION AND DEFENSE, AND (6) PROVISION OF AN EFFECTIVE SUBSTITUTE FOR THE GRAND JURY SYSTEM.
