REVIEW OF THE DECISION OF THE FIFTH CIRCUIT COURT OF APPEALS TO ALLOW PUBLICATION OF COURTROOM SKETCHES IN UNITED STATES V CBS AND ITS POSSIBLE IMPACT ON TRIAL COVERAGE BY MEDIA.
Abstract
IN CBS, THE CONTEMPT POWERS OF THE TRIAL JUDGE ARE LIMITED TO MAINTAINING THE COURT AS A DISPASSIONATE FORUM AND PROTECTING THE DEFENDANT FROM PREJUDICIAL TREATMENT BY THE PRESS, TO PRESERVE THE RIGHT OF THE DEFENDANT TO A FAIR TRIAL. THE AUTHOR SUGGESTS THAT A CLEARER DISTINCTION BETWEEN THE MAKING OF PHOTOGRAPHS AND THE MAKING OF SKETCHES THAN IS MADE IN CBS IS NECESSARY TO AVOID A REDEFINITION OF THE RIGHTS OF THE PRESS.
