NINE STANDARDS FOR THE IMPROVEMENT OF UTAH SENTENCING PROCEDURES ARE OUTLINED, COVERING SUCH ISSUES AS PRESENTENCE REPORTS, NONINSTITUTIONAL SENTENCES, AND FACTORS AFFECTING SENTENCING.
Abstract
THIS PAMPHLET IS ONE OF A SERIES OF REPORTS OF THE UTAH COUNCIL ON CRIMINAL JUSTICE ADMINISTRATION. THE STANDARDS AND RECOMMENDATIONS CONTAINED IN THESE REPORTS ARE BASED LARGELY ON THE WORK OF THE NATIONAL ADVISORY COMMISSION ON CRIMINAL JUSTICE STANDARDS AND GOALS. STANDARDS ARE PROVIDED ON HABITUAL OFFENDER SENTENCING; REFORM OF COURT SENTENCING POLICIES WITH RESPECT TO PROBATION; LEGISLATION ON USE OF FINES AND CRITERIA FOR IMPOSING FINES; AND ON THE EFFECT OF GUILTY PLEAS ON SENTENCING. ALSO INCLUDED ARE STANDARDS RELATING TO CREDIT FOR TIME SERVED, JUDGES' ABILITY TO COMMUTE SENTENCES OR REMIT FINES, JUDICIAL VISITS TO CORRECTIONAL INSTITUTIONS, REQUIREMENTS FOR PRODUCING PRESENTENCE REPORTS, CONTENTS OF PRESENTENCE REPORTS, AND DISCLOSURE OF PRESENTENCE REPORTS.
