A history of rape, Canadian rape laws and statistics, as well as common rape myths are presented with an emphasis on the feminist point of view.
Abstract
Through increased research and publications, the feminist movement has recently begun to break the taboos surrounding rape. A history of the offense indicates that in earlier times rape was chiefly considered a violation of male property rights (be it those of husband or father). Present Canadian rape laws still reflect patriarchal thinking in that the woman is always considered the victim and the male the aggressor, and in that the female must prove that she did not consent to the act. Canadian rape statistics indicate that only very few of the reported offenses lead to arraignment or conviction of the offender; for instance in 1977, only 198 men were arraigned out of 480 valid reported rapes. Particular problems are posed by the fact that rape is still surrounded by numerous myths. Myth: Rape is a spontaneous act committed in the heat of passion; in reality, a large number of rapes are premeditated. Myth: Rape is a crime committed by a single offender; in 43 percent of the cases, 2 or more assailants are involved. Myth: The rapist usually remains anonymous; in fact, victim and offender know each other in many cases. Myth: Rape serves mainly to satisfy sexual lust; in reality rape is an act of violence. Myth: The victim provokes the offense; however, rape victims are of all ages and physical appearances. The article urges that sex legislation, the public attitudes towards rape, and the treatment of victims be improved. A 24-item bibliography is included.
