This monograph presents Virginia's codified rights and procedures for juveniles, especially as they affect the daily practice of Virginia law enforcement personnel; attention is given to jurisdiction of the juvenile and domestic relations district court as well as the police investigative process.
Abstract
The discussion of jurisdiction focuses on venue, age, and subject matter that give jurisdiction to the juvenile court. The first section bearing upon the police investigative process and the juvenile offender portrays procedures for taking juveniles into immediate custody, the handling of abuse and neglect cases, lineups and other pretrial identifications, and the confidentiality of police records. The second section dealing with the investigative process discusses only the searching of juveniles, including searches incident to taking into immediate custody, consent searches, and school searches. The final section considers interrogation and interview, with attention to the issues of constructive custody and waiver under the Miranda rights. The appendixes contain a glossary, an information pamphlet of the Virginia juvenile and domestic relations court, selected forms, and selected constitutional amendments. Seventy-seven footnotes are provided.
