A DESCRIPTION OF THE APPLICATIONS AND BENEFITS OF THE SENTENCING ALTERNATIVE OF 'WEEKEND DETENTION', IN WHICH CERTAIN TYPES OF OFFENDERS SERVE THEIR SENTENCINGS DURING WEEKENDS ONLY, REMAINING IN THE COMMUNITY ON WEEKDAYS.
Abstract
WEEKEND DETENTION HAS BEEN USED IN A NUMBER OF COUNTRIES AS A MEANS OF BRINGING THE OFFENDER INTO CONTACT WITH CORRECTIONAL TREATMENT WHILE, AT THE SAME TIME, AVOIDING THE DANGERS OF A PRISON TERM SERVED IN A SINGLE PERIOD. THE AUTHOR TRACES THE HISTORY OF WEEKEND DETENTION SINCE ITS INTRODUCTION INTO BELGIUM, SPAIN, AND THE FEDERAL REPUBLIC OF GERMANY IN RECENT YEARS. HE LISTS THE BENEFITS OF THIS FORM OF SENTENCE WHICH, HE ARGUES, COULD BE EMPLOYED BY THE COURTS IN A NUMBER OF COUNTRIES WITHOUT AMENDING THEIR CRIMINAL CODES. HE SUGGESTS THAT WEEKEND DETENTION MAY BE USED EITHER AS A FORM OF RETRIBUTIVE PUNISHMENT OR AS A REHABILITATIVE SENTENCE. FOR THE WEEKEND DETENTION TO BE AN EFFECTIVE REHABILITATIVE TOOL, THE AUTHOR STATES THAT IT SHOULD BE ACCOMPANIED BY PSYCHOTHERAPY OR SOME OTHER FORM OF TREATMENT PROVIDED SPECIAL PERSONNEL AND FACILITIES CAN BE MADE AVAILABLE. --IN SPANISH
