WEST VIRGINIA'S PLAN FOR ASSURING THE ACCURACY, SECURITY, AND CONFIDENTIALITY OF CRIMINAL HISTORY DATA IS SET FORTH.
Abstract
THE PLAN IS INTENDED TO BE USED AS AN INSTRUCTIONAL DOCUMENT AS WELL AS A GUIDE TO COMPLIANCE WITH DEPARTMENT OF JUSTICE REGULATIONS. THE PLAN OPENS WITH DISCUSSIONS OF INTERRELATIONSHIPS AMONG THE COMPONENTS OF THE CRIMINAL JUSTICE SYSTEM, THE ROLE OF THE CRIMINAL IDENTIFICATION BUREAU, AND PRIVACY AND SECURITY AS A PUBLIC ISSUE. THE SCOPE OF THE PLAN AND RELEVANT TERMINOLOGY ARE DEFINED. LEVELS OF COMMITMENT AND RESPONSIBILITY FOR ADMINISTERING THE PLAN ARE IDENTIFIED. THE STATUS OF WEST VIRGINIA'S CRIMINAL JUSTICE ORGANIZATION IS DISCUSSED, AND PROPOSED ROLES AND RESPONSIBILITIES ARE IDENTIFIED FOR THE GOVERNOR; THE GOVERNOR'S COMMITTEE ON CRIME, DELINQUENCY, AND CORRECTION; THE STATE DEPARTMENT OF PUBLIC SAFETY/CRIMINAL IDENTIFICATION BUREAU; THE PRIVACY AND SECURITY BOARD OF APPEALS; AND LOCAL USER AGENCIES AND AGENCY PERSONNEL. PROVISIONS FOR COMPLYING WITH REGULATIONS FOR DATA ACCURACY, COMPLETENESS, TIMELINESS, AND CONTROL ARE SET FORTH, AS ARE PROVISIONS WITH REGARD TO LIMITATIONS ON DISSEMINATION, INDIVIDUAL ACCESS AND REVIEW, AND SYSTEM SUPPORT ACTIVITIES (AUDIT, SANCTIONS, TRAINING, PUBLIC REPORTING, ANNUAL REPORT). STEPS TOWARD THE DEVELOPMENT OF A SECURITY PROGRAM ARE OUTLINED, AND CATEGORIES OF SECURITY BREACHES ARE DISCUSSED. A SCHEDULE FOR IMPLEMENTING THE PLAN IS PROVIDED, TOGETHER WITH SUPPORTING DOCUMENTATION.
