SUSPENSION AND EXPULSION ARE DEFINED, AND PROCEDURES AND STUDENT RIGHTS CONCERNING THESE ACTIONS ARE EXPLAINED TO STUDENTS IN THE CHICAGO, ILL., PUBLIC SCHOOLS.
Abstract
A QUESTION-AND-ANSWER FORMAT IS USED TO DISCUSS THE ISSUE OF SUSPENSION AND EXPULSION. SUSPENSION OCCURS WHEN A STUDENT IS TOLD TO STAY AWAY FROM SCHOOL FOR ANY LENGTH OF TIME UP TO 10 SCHOOL DAYS; IT IS APPLICABLE IF A SCHOOL OFFICIAL BELIEVES THE STUDENT GUILTY OF MISCONDUCT OR IF THE STUDENT IS BELIEVED TO HAVE VIOLATED A PROVISION OF THE SCHOOL'S DISCIPLINE CODE. STUDENTS MAY BE SUSPENDED EVEN IN SCHOOLS WHERE THERE IS NO DISCIPLINE CODE; HOWEVER, THE ACTION MUST BE CARRIED OUT BY THE PRINCIPAL AFTER A HEARING IS HELD BETWEEN THE PRINCIPAL AND THE STUDENT. PARENTS MUST BE NOTIFIED OF THE SUSPENSION IMMEDIATELY. A STUDENT WHO FEELS THE HEARING WAS UNJUST CAN APPLY TO THE CHICAGO PUBLIC EDUCATION PROJECT (CPEP) FOR ASSISTANCE. EXPULSION OCCURS WHEN A STUDENT IS PROHIBITED FROM ATTENDING SCHOOL FOR A PERIOD LONGER THAN 10 DAYS. SERIOUS MISBEHAVIOR, SUCH AS ATTACKING A PERSON, IS CAUSE FOR EXPULSION. A DUE PROCESS HEARING MUST BE HELD BEFORE AN IMPARTIAL HEARING OFFICER, AND THE STUDENT IS ALLOWED AN ATTORNEY AND THE RIGHT TO PRESENT WITNESSES. PARENTS MUST BE NOTIFIED OF THE TIME, DATE, AND PURPOSE OF THE HEARING. THE HEARING OFFICER WILL MAKE A RECOMMENDATION AT THE TIME OF THE HEARING AND THE DISTRICT SUPERINTENDENT MAKES THE DECISION TO EXPEL. (DAG)
