THE AUTHOR, A RETIRED SUPREME COURT JUSTICE, OUTLINES A CASE FOR THE ADOPTION OF THE ABA STANDARDS FOR CRIMINAL JUSTICE AS A MEANS OF ACHIEVING A MORE EFFECTIVE CRIMINAL JUSTICE SYSTEM IN EACH STATE AND FEDERAL JURISDICTION.
Abstract
THE POSITIVE EXPERIENCES OF JURISDICTIONS WHICH HAVE IMPLEMENTED THESE ABA STANDARDS SINCE 1973 HAVE LED TO IMPLEMENTATION ACTIVITY IN OVER 40 STATES. SPECIFIC EXPERIENCES ARE MENTIONED, AND CERTAIN POSITIVE ASPECTS AND IMPROVEMENTS OVER THE OLD SYSTEM OF CRIMINAL JUSTICE HIGHLIGHT THE ARGUMENT FOR ADOPTION OF THE NEW STANDARDS. THE ARTICLE URGES FAMILIARITY WITH THE NEW STANDARDS AND APPRECIATION OF THE MOMENTUM ALREADY GAINED TOWARD ACCEPTANCE OF THE STANDARDS THROUGH APPELLATE CITATIONS AND IMPLEMENTATION IN SOME STATE'S COURT DECISIONS. THE ARTICLE ENCOURAGES STATES TO ADAPT THE STANDARDS TO THEIR OWN STATE AND LOCAL NEEDS. (RBS)
