Business lawyers should consider using mediation to resolve their clients' business disputes.
Abstract
Many business lawyers avoid mediation as a tool of dispute resolution because they do not know what it is. They confuse mediation with arbitration. Others fear losing control of their clients' cases by using mediation. Still others fear losing fees or billing fewer hours if mediation is used. However, the success rate of mediation in resolving business disputes is 80 percent. Additionally, mediation saves the client time and money, and it reduces risk. While not all business cases will benefit from mediation, it is an option that should be given serious consideration by business lawyers.
