FINAL REPORT OF A STUDY TO FIND WAYS TO EXPEDITE THE HANDLING OF APPEALS IN WISCONSON WHILE PRESERVING TRADITIONAL VALUES OF COLLEGIALITY AND DELIBERATION.
Abstract
INTERVIEWS WERE CONDUCTED WITH WISCONSIN SUPREME COURT JUSTICES, COURT SUPPORT STAFF, THE STATE PUBLIC DEFENDER, THE ASSISTANT ATTORNEY GENERAL, STATE BAR EXECUTIVES, AND SEVERAL ATTORNEYS SPECIALIZING IN APPELLATE PRACTICE. WISCONSIN'S CONSTITUTIONAL AND STATUTORY PROVISIONS AND THE RULES OF COURT WERE ALSO EXAMINED. THE REPORT RECOUNTS EACH SEPARATE PROCESS AND PERSONNEL FUNCTION FROM THE TIME OF TRIAL COURT DECISION TO COMPLETION OF APPELLATE REVIEW BY THE SUPREME COURT. A STATISTICAL ANALYSIS OF TIME PERIODS IN THE APPELLATE PROCESS IS INCLUDED. SUGGESTIONS FOR PROCEDURAL CHANGES ARE DERIVED FROM RECOMMENDATIONS OF NATIONAL ORGANIZATIONS AND SUGGESTIONS OF STATE SUPREME COURT JUSTICES AND STAFF.
