STATISTICS AND NARRATIVE INFORMATION ON PROBATION ADMISSIONS TO THE WISCONSIN DIVISION OF CORRECTIONS IN 1976 ARE PRESENTED.
Abstract
OFFENSES FOR WHICH ADULTS WERE PLACED ON PROBATION IN 1976 ARE GROUPED ACCORDING TO FIVE CATEGORIES: OFFENSES AGAINST PERSONS, PROPERTY OFFENSES, DRUG OFFENSES, SEX OFFENSES, AND ALL OTHER OFFENSES. TYPES OF DISPOSITION POSSIBLE IN A PROBATION CASE ARE IMPOSED AND STAYED SENTENCE, WITHHELD SENTENCE, AND PROBATION WITHOUT CONVICTION. AN IMPOSED AND STAYED SENTENCE IS ONE IN WHICH THE COURT SENTENCES THE INDIVIDUAL TO A SPECIFIED PERIOD OF TIME IN A CORRECTIONAL INSTITUTION, STAYS THE SENTENCE, AND PLACES THE INDIVIDUAL ON PROBATION. A PERSON WHO RECEIVES A WITHHELD SENTENCE AND WHO IS FOUND TO HAVE VIOLATED TERMS OF PROBATION MUST BE RETURNED TO THE COMMITTING COURT FOR SENTENCING. PROBATION WITHOUT CONVICTION IS A DISPOSITION USED IN CASES WHERE INDIVIDUALS HAVE PLEADED GUILTY TO OR HAVE BEEN FOUND GUILTY OF VIOLATING CERTAIN PROVISIONS OF THE UNIFORM CONTROLLED SUBSTANCES ACT. ADMISSIONS TO STATE-SUPERVISED ADULT PROBATION DECREASED SLIGHTLY FROM 8,343 IN 1975 TO 8,124 IN 1976. SLIGHTLY MORE THAN 22 PERCENT OF THE ADULTS PLACED ON PROBATION HAD BEEN CONVICTED OF DRUG LAW VIOLATIONS. HALF OF THE MEN AND WOMEN RECEIVED SENTENCES OF LESS THAN 2 YEARS. SIX OUT OF TEN PERSONS WERE UNDER 25 YEARS OF AGE. OVER HALF OF THE ADULTS WERE WHITE; 6 OUT OF 10 MEN AND 5 OUT OF 10 WOMEN WERE SINGLE AT THE TIME OF PLACEMENT ON PROBATION; OVER HALF OF THE WOMEN AND UNDER HALF OF THE MEN WERE UNEMPLOYED; AND ABOUT 10 PERCENT OF THE ADULTS EARNED UNDER $200 PER MONTH AT THE TIME OF PLACEMENT ON PROBATION.
