This report describes four Wisconsin bills (1989 Assembly Bills 451, 452, 453, 454) concerning legislation on tribal courts and tribal vital records and presents the results of the Survey of Tribal Courts.
Abstract
Assembly Bill 451 relates to enforcement of tribal domestic abuse, temporary restraining orders, and injunctions. Bill 452 relates to tribal vital records and the granting of rulemaking authority. Bill 453 relates to demerit points for tribal court traffic convictions, and Bill 454 relates to tribal court proceedings and acts of tribal legislatures. The Survey of Tribal Courts, developed to provide information to the Advisory Committee on Tribal Courts to assist its legislation, was submitted to 11 tribes and bands in Wisconsin on October 24, 1988. As of February 10, 1989, all 11 had responded, seven indicating that they have a tribal court, and three indicating that they are considering establishing one. Part One of the survey contains information on when each tribal court started, what their jurisdictions are, tribal judge status and qualifications, court proceedings, policies, and records. Part Two contains information on courtless tribes and bands and their plans for establishing or not establishing a tribal court.
