MODEL ADMINISTRATIVE RULES FOR STATE PUBLIC DEFENDER OFFICES, PROMULGATED BY THE NATIONAL LEGAL AID AND DEFENDER ASSOCIATION, ARE PRESENTED.
Abstract
THE RULES WERE DEVELOPED FOR THE WISCONSIN PUBLIC DEFENDER OFFICE, WHICH IS RESPONSIBLE FOR CERTIFYING PRIVATE ATTORNEYS TO PROVIDE DEFENSE SERVICES FOR INDIGENT CLIENTS, FOR ASSIGNING ATTORNEYS TO CASES, AND FOR COMPENSATING ATTORNEYS. THE RULES COVER THE FOLLOWING: (1) CERTIFICATION (ANNUAL REVIEW, ATTORNEYS NEWLY ADMITTED TO THE WISCONSIN BAR, CERTIFICATION APPLICATION AND CRITERIA, APPEAL OF CERTIFICATION DECISIONS, ACCESS TO THE FILES OF THE STATE CERTIFYING BOARD), (2) ASSIGNMENT PROCEDURES (EMERGENCY AND ROUTINE ASSIGNMENTS OF COUNSEL TO REPRESENT INDIGENT DEFENDANTS, CONFLICT OF INTEREST CRITERIA, PUBLIC REPRESENTATION AFTER A CASE IS COMMENCED BY PRIVATELY RETAINED COUNSEL, COURT'S RIGHT TO REVIEW INDIGENCY DETERMINATIONS, SPECIAL TYPES OF REPRESENTATION, INVESTIGATIVE AND EXPERT SERVICES FOR ASSIGNED COUNSEL, ETC.), (3) INDIGENCY CRITERIA (DETERMINING WHETHER THE COST OF RETAINED COUNSEL EXCEEDS A DEFENDANT'S ABILITY TO PAY, PROVISIONS FOR PARTIAL PAYMENT), AND (4) PAYMENT OF CERTIFIED ATTORNEYS (BILLING FORM, SUBMISSION OF BILL, APPEALS BY ATTORNEYS OF REDUCTIONS IN SUBMITTED BILLS BY THE STATE PUBLIC DEFENDER).
