THIS PLAN COVERS DISSEMINATION PROCEDURES, CHALLENGES OF INFORMATION, COMPUTER ACCESS, AND STATUTORY AUTHORITY FOR NON-CRIMINAL JUSTICE USE.
Abstract
THE PLAN, PREPARED PURSUANT TO RULES AND REGULATIONS ISSUED BY THE DEPARTMENT OF JUSTICE ON MAY 20, 1975, FORMALIZES TACIT POLICIES AND AGREEMENTS WHICH HAD BEEN IN OPERATION IN THE STATE. IT SPELLS OUT PROCEDURES TO BE USED BY CRIMINAL JUSTICE AGENCIES, NON-CRIMINAL JUSTICE AGENCIES, AND INDIVIDUALS WHO WISH ACCESS TO CRIMINAL HISTORIES. A TIME LIMIT OF 1 YEAR IS PUT ON USE OF SUCH INFORMATION WHEN NO DISPOSITION OF THE CHARGE HAS BEEN RECORDED OR NO ACTIVE PROSECUTION OF THE CHARGE IS PENDING. LIMITS ON DISSEMINATION ARE SPELLED OUT, AND AGENCIES RESPONSIBLE FOR VARIOUS SEGMENTS OF THE INFORMATION SYSTEM ARE NAMED. A PROCEDURE IS DETAILED WHEREBY THE PERSON WHO FINDS HIS RECORD IN ERROR CAN HAVE IT CHANGED. APPENDIXES INCLUDE: THE INFORMATION PRACTICES EXECUTIVE ORDER, DESCRIPTION OF THE IDENTIFICATION DIVISION, SAMPLE OFFENSE REPORTS, MANDATORY REPORTING LEGISLATION, TERMINAL USERS AND DISSEMINATION AGREEMENT, AN EXAMPLE STATUTE ALLOWING ACCESS BY A NON-CRIMINAL JUSTICE AGENCY (REAL ESTATE), SECURITY AND PRIVACY LEGISLATION, THE JUVENILE COURT ACT OF 1971, A FORM FOR REQUEST FOR RECORD REVIEW, THE ADMINISTRATIVE PROCEDURE ACT, AND THE LEAA APPROVAL OF THE PLAN.
