THE PAPER EXAMINES THE PROPOSALS OF THE 1978 GREEN PAPER 'YOUTH CUSTODY AND SUPERVISION' FOR THE 17-21 AGE GROUPS AND SUMMARIZES THE COMMENTS MADE ABOUT IT BY BRITISH CRIMINAL JUSTICE ORGANIZATIONS.
Abstract
THE GREEN REPORT, CONCERNS ITSELF WITH THE REORGANIZATION OF CUSTODIAL PROVISIONS AND THE BEST UTILIZATION OF EXISTING RESOURCES. PROPOSALS OF THE GREEN REPORT RELATING TO THE GENERIC SENTENCE, REGIMES, ARRANGEMENTS FOR RELEASE, SUPERVISION ON RELEASE, LICENSING ON RECALL, JUVENILES, AND FEMALE OFFENDERS ARE DETAILED. SOME OF THESE INCLUDE A SINGLE YOUTH CUSTODY SENTENCE REPLACING THE CURRENT THREE-PART CUSTODIAL SENTENCE, A FIXED PERIOD OF REMISSION (ONE-THIRD OF THE SENTENCE) WITH SOME PROVISION FOR EARLY RELEASE, AND THE PROVISION OF YOUTH CUSTODY UNITS FOR YOUNG WOMEN (AGED 16-21) ATTACHED TO SEVERAL ADULT FEMALE ESTABLISHMENTS. COMMENTATORS ON THESE AND OTHER PROPOSALS ARE DISSATISFIED WITH THE EMPHASIS ON CUSTODY. THEY NOTE THE FAILURE OF THE GREEN PAPER TO CONSIDER EVIDENCE OF THE INEFFECTIVENESS OF CUSTODY, THEY ARGUE FOR A COMPLETE SHIFT TO NONCUSTODIAL RESOURCE DEVELOPMENT, AND THEY POINT OUT THE ABANDONMENT OF THE NEIGHBORHOOD ESTABLISHMENT FOR CUSTODIAL SENTENCES. A SUMMARY OF THE RECOMMENDATIONS IS INCLUDED.
