THIS REPORT DESCRIBES THE TRIPARTITE SYSTEM FOR BRITISH YOUNG OFFENDERS AND OUTLINES THE PROPOSED GENERIC SENTENCE WHICH WOULD REPLACE EXISTING SENTENCES AND UNIFY THE SYSTEM.
Abstract
IN THE 1950'S BORSTAL WAS CONSIDERED A TRAINING SENTENCE FOR YOUNG SELECTED OFFENDERS; IMPRISONMENT AS A SENTENCE FOR THOSE COMMITTING SERIOUS OFFENSES AND EXCLUDED FROM BORSTAL; AND DETENTION, FOR SHORT-TERM, INSTITUTIONALLY-UNSOPHISTICATED OFFENDERS. IN 1977, HOWEVER, THE MAJORITY OF THOSE SENTENCED TO DETENTION CENTERS HAD PREVIOUS CONVICTIONS; MOREOVER, EDUCATION, WORK TRAINING, AND SOCIAL TRAINING WERE EMPHASIZED IN MOST DETENTION AND YOUNG PRISONER CENTERS. BASED ON THE RECOMMENDATIONS OF THE ADVISORY COUNCIL ON THE PENAL SYSTEM, THIS GOVERNMENT GREEN PAPER SUGGESTS THAT A NEW CUSTODIAL SENTENCE BE ADOPTED--THE CUSTODY AND CONTROL ORDER. THIS SENTENCE WOULD REMOVE NOMINAL DISTINCTIONS BETWEEN YOUNG OFFENDERS ON THE BASIS OF REGIME, SUBSTITUTE DISTINCTIONS BASED ON OFFENSE SEVERITY AND NEED FOR DETERRENCE, ELIMINATE THE NEED FOR THREE DIFFERENT ESTABLISHMENTS, AND ENCOURAGE GREATER SUPPORT AND ASSISTANCE TO YOUNG OFFENDERS THROUGH COMMUNITY SUPERVISION UPON RELEASE AND TRAINING AND EDUCATION CLOSE TO HOME. A SUMMARY OF THE GOVERNMENT'S MAIN PROPOSALS DISCUSSES YOUTH CUSTODY SENTENCING, THE REGIME IN YOUTH CUSTODY CENTERS, ARRANGEMENTS FOR RELEASE, RELEASE SUPERVISION, LICENSING AND RECALL, CHANGES IN JUVENILE ACCOMODATIONS, AND SPECIAL PROVISIONS FOR FEMALE OFFENDERS. APPENDIXES LIST THE LOCATION, PURPOSE, AND MAXIMUM NUMBER OF INMATES OF EACH PRISON DEPARTMENT ESTABLISHMENT AND PRESENT STATISTICAL GRAPHS AND TABLES ON PRISON DEPARTMENT POPULATIONS. (AOP)
