THIS PAPER EXAMINES THE CRIMINAL SANCTIONS EMBODIED IN THE PRIVACY ACT OF 1974; EMPHASIS IS PLACED ON THE IMPACT OF SECTION (1), WHICH DEALS WITH OFFICERS AND EMPLOYEES OF AGENCIES.
Abstract
THE ACT REGULATES THE MAINTENANCE, USE, TRANSFER, AND DISSEMINATION OF INFORMATION ABOUT INDIVIDUALS WHICH IS KEPT ON FILE OR IN COMPUTERS BY FEDERAL AGENCIES. THE ACT REQUIRES THE FEDERAL AGENCY TO GIVE PUBLIC NOTICE THAT SYSTEMS OF RECORDS ARE BEING MAINTAINED AND TO PUBLISH VARIOUS CHARACTERISTICS OF THE SYSTEMS. THE ACT ALSO PROVIDES CIVIL AND CRIMINAL REMEDIES FOR VIOLATION OF THE ACT BY AGENCY OFFICERS OR EMPLOYEES.
